Mountain Shadows Covenants

There are quite a few misguided perceptions regarding the importance and enforceability of covenants. Homeowners typically choose to live in a covenant-safeguarded neighborhood because they are interested in maintaining property value, and because they expect neighborhood etiquette of their neighbors.

Organizing your neighborhood ahead of time is important to prevent issues like:

  • A home that is built substantially smaller than the other homes, thus bringing down home values.
  • A home painted in a color drastically different from all surrounding homes.
  • A home with an outbuilding/structure outside covenant guidelines.
  • A home with a chain link fence around the front/rear perimeter of its yard.


Covenants and an established Approving Authority (AA) protect you from these and similar scenarios, and are meant to protect property values and ensure the quality of life we have grown accustomed to in Mountain Shadows. The most effective way to be proactive about protecting your home’s value is to make sure you have an AA in your filing. With an AA, your neighborhood can make sure every home being built or repaired in your filing adheres to your covenant standards. Without an AA, you may not have an opportunity to object to a neighbor’s “poor taste.”

Example: If your neighbor builds a larger new home, which blocks some of your view, what can you do? Without an AA, there is no approval process for new homes, leaving you without much recourse. With an AA, the homeowner must get approval before building, which keeps everyone consistent with the covenants. The AA (a three-person committee), ensures that new construction is in compliance with covenants. The covenants are legal contracts between neighbors that can be enforced by the courts when necessary.

While we encourage all filings to have their own AA, we cannot stress enough how critical an AA will be in each area with downed or damaged homes. If your filing is in this situation and you want to organize an AA, please contact one of your Mountain Shadows Community Association covenant co-chairs below.
