HB-1225 as it relates to the Waldo Canyon Fire

In the recently concluded legislative session, the General Assembly considered and passed HB-1225 which addresses certain practices surrounding the sale of Homeowners policies and the handling of their claims largely prompted by last year’s wildfires. Governor Hickenlooper signed this bill on May 10, 2013 which now makes it law. 

Most of the new law does not go into effect until 01-01-14 and will affect all Colorado homeowners’ policies. However, there is one section of the law which may affect homeowners affected by the Waldo Canyon Fire. This section changes the current homeowner policy requirement that policyholders need to bring suit against their insurance companies within one year of the loss date and replaces this time limit with the usual Colorado three year statute of limitations. Based upon our information, this is the interpretation that the legislature intended but, like many laws, interpretations can vary.

How does this one change affect residents in the Waldo Canyon Fire area?

If you have settled with your insurance carrier or have largely settled and have gotten time extensions for the replacement or repair of your homes, there is no impact and you do not need to take any action. If you have not settled or gotten time extensions beyond the usual one year time period, you should take the following actions:

  • Communicate with your insurance carrier to verify that they agree with the above interpretation of the time limit for bringing suit; and
  • Confirm with them that they agree to extend the timeframes for repairing or replacing your damaged homes beyond the one year. 

If they do not agree with this interpretation or will not extend their policy loss timelines, you should seek legal help to determine your next steps in resolving your claim. You need to make certain your policy rights are protected.

When should homeowners who have not settled need to take the above steps? 

You are now under thirty (30) days from the one year anniversary of the loss date that damaged your homes. Please seek the recommended clarifications immediately so you will have some time to seek legal help in the event your carrier does not agree with this interpretation or will not extend your replacement or repair time limits. 

If you are still working with your insurance company, hopefully this will give you both some additional time to seek a conclusion to your claim.
